I still have heard no word from Nintendo about the legalization of homebrew software for 3DS (new and old systems). However, I was given the following information this morning:
“While you await Nintendos confirmation, you may watch the video I released on youtube of the app running from the SD” – Homebrew Designer Artwiz
“Finally we can program our own 3DS homebrew with no flash card. Download other homebrew for free. The 3DS version is only out in JPN, but has a promised release of North America. For now you can buy Petit Computer which is out in all regions.

As there were quite a few people who doubted that it was true that Nintendo legalized homebrew for the old and new 3DS. I decided to ask the original source of this story (Homebrew Designer Artwiz) directly if it´s false or legit, and this is what Artwiz had to say:
“The program lets you program code signed through the the app liscensed by Nintendo. I own a JPN console and am biulding my own amazing programs. Besides the people on twitter dont know because they dont own the program, they keep eagerly waiting and searching for any new news of it. You’d have to goto smilebasics twitter page.” – Homebrew Designer Artwiz
So there you have it, I have also contacted Nintendo about it. So I´m waiting for their answer as well.

***RUMOR***
I was just informed by a 3DS homebrewer (Homebrew Designer Artwiz) that Nintendo has now legalized homebrew for the new and old 3DS. So if that´s true, then it means that people will soon be able to create whatever they want, so that of course means tons of homebrew for everyone! And from what I’ve been told SmileBASIC (the sequel to Petit Computer) is coming to the Nintendo Eshop in the US and EU vin the near future (Petit Computer is already out for Japanese 3DS consoles).
However, SmileBASIC won´t be released outside of Japan until Spring arrives (the price has not yet determined on the Nintendo Eshop), but hopefully SmileBASIC will be worth waiting for. As the software will offer more features, options and fuctions than Petit Computer ever did.
